By creating an account, signing in, or otherwise accessing the Applied Science platform ("the Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions ("these Terms") in their entirety. If you do not agree to any provision of these Terms, you must not access or use the Platform. Your continued use of the Platform following any amendment to these Terms constitutes your acceptance of the amended version.
"Applied Science" refers to the operator of the Platform, including its coaches, employees, and affiliates. "The Platform" refers to all digital services, applications, content, and features provided by Applied Science. "User" refers to any individual who accesses the Platform, including Athletes and Coaches. "Athlete" refers to a User who receives coaching services through the Platform. "Coach" refers to a User who provides or manages coaching services through the Platform. "Content" refers to all training programmes, exercise demonstrations, supplement protocols, performance data, messages, and other materials available on or generated through the Platform.
The Platform provides digital tools for elite athletic coaching, including but not limited to: personalised training programme delivery, exercise video demonstrations, supplement protocol management, session logging and performance tracking, AI-assisted session review, communication between Athletes and Coaches, and billing management. The Platform is a software-as-a-service product. Applied Science does not guarantee specific athletic outcomes, performance improvements, or fitness results. All coaching content is provided for informational and guidance purposes and does not constitute medical advice.
By using the Platform, you represent and warrant that: (a) you are at least 18 years of age, or if under 18, you have obtained the consent of a parent or legal guardian who has reviewed and agreed to these Terms on your behalf; (b) you have the legal capacity to enter into a binding agreement; (c) all information you provide is accurate, complete, and current; (d) you will maintain the security of your account credentials and promptly notify Applied Science of any unauthorised use; and (e) your use of the Platform complies with all applicable laws and regulations. Athletes acknowledge that participation in physical training carries inherent risks, and they have consulted with appropriate medical professionals before beginning any training programme.
Users must register an account using a valid email address. Athletes must use the email address associated with their payment. Coaches must be approved by Applied Science before gaining access to coaching tools. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Applied Science reserves the right to suspend or terminate accounts that are inactive for extended periods, suspected of unauthorised use, or in violation of these Terms. You may not share, transfer, or sell your account to any third party.
Athlete memberships are billed on a monthly or annual basis as selected at checkout. Coach subscriptions are billed annually according to the selected plan: Starter (£150 per year, up to 10 athletes), Pro (£200 per year, up to 20 athletes plus extra services), or Elite (£350 per year, unlimited athletes plus premium services). All fees are payable in advance via Stripe. Payments are processed securely by Stripe; Applied Science does not store your card details. Fees are non-refundable except where required by applicable law. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period and you will retain access until then. Applied Science reserves the right to change pricing with at least 30 days' notice; price changes take effect at the next renewal date after notice. If a payment fails, access to the Platform may be suspended until payment is resolved. All transactions include the applicable app identifier for tracking and reconciliation purposes. Platform Service Fee. Applied Science charges a platform service fee of 5% on every Athlete membership payment. The Athlete pays the full membership amount displayed at checkout; of that amount, 95% is transferred to the Coach and 5% is retained by Applied Science as the platform service fee to maintain the AI coaching tools, infrastructure, support, and continued development of the Platform. This fee is deducted automatically from each transaction and is non-refundable except where a refund is issued for the underlying payment. By paying a membership fee, the Athlete acknowledges and agrees to this fee structure.
The training programmes, exercises, supplement protocols, and any other Content provided through the Platform are intended for healthy individuals with no known medical conditions. Applied Science, its Coaches, and its affiliates are not medical professionals and do not provide medical diagnosis, treatment, or advice. Before beginning any training or supplementation programme, you must consult with a qualified medical professional, particularly if you have any pre-existing medical condition, injury, or are taking medication. You acknowledge that physical exercise carries inherent risks of injury, including serious injury or death. You voluntarily assume all such risks. Supplement protocols are recommendations only; you are solely responsible for verifying the safety, legality, and suitability of any supplement for your individual circumstances, including compliance with anti-doping regulations applicable to your sport. Applied Science accepts no liability for any adverse health outcome, injury, or failed drug test resulting from your use of the Platform or its Content.
The Platform includes an AI-powered session review feature that analyses Athlete session logs and generates technical feedback. This feedback is generated by artificial intelligence and may contain errors, inaccuracies, or inappropriate suggestions. AI-generated feedback is not a substitute for professional coaching judgement. Coaches must independently review and validate all AI-generated feedback before acting on or communicating it to Athletes. Applied Science accepts no liability for decisions made based on AI-generated content. The AI feature is provided "as is" without any warranty of accuracy, reliability, or fitness for purpose.
You agree not to: (a) use the Platform for any unlawful, harmful, or fraudulent purpose; (b) upload, post, or transmit any content that is defamatory, obscene, abusive, harassing, or otherwise objectionable; (c) attempt to gain unauthorised access to any part of the Platform, other accounts, or computer systems; (d) interfere with or disrupt the Platform's servers, networks, or security features; (e) reverse engineer, decompile, or disassemble any part of the Platform; (f) scrape, copy, or distribute Platform Content without authorisation; (g) impersonate another person or misrepresent your affiliation; or (h) use the Platform to train or develop competing AI or coaching products. Violations may result in immediate account termination and legal action.
The Platform, including its design, software, branding, exercise library, and all original Content, is the intellectual property of Applied Science and is protected by applicable copyright, trademark, and other laws. Coaches retain ownership of training programmes and protocols they create on the Platform but grant Applied Science a non-exclusive, royalty-free licence to host, store, and display such Content for the purpose of operating the Platform. Athletes retain ownership of their personal performance data. You may not copy, modify, distribute, or create derivative works from the Platform without express written permission from Applied Science.
Applied Science processes personal data in accordance with the General Data Protection Regulation (GDPR) (EU 2016/679) and applicable UK data protection law. Personal data includes your name, email, payment information (processed by Stripe), health and performance data, and usage data. We process this data on the legal basis of contract performance, legitimate interests, and your consent. Your data is used to provide coaching services, process payments, communicate with you, and improve the Platform. You have the right to access, rectify, erase, restrict, or object to the processing of your data, as well as the right to data portability. To exercise these rights, contact Applied Science. We do not sell your personal data. Data is stored for as long as your account is active and for a reasonable period thereafter for legal and accounting purposes. Data may be transferred to and processed in countries outside the EU/EEA; where this occurs, appropriate safeguards are in place.
To the maximum extent permitted by law, Applied Science, its directors, employees, coaches, affiliates, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or physical injury, arising from or related to your use of or inability to use the Platform. Applied Science's total aggregate liability for all claims arising from these Terms or your use of the Platform shall not exceed the total amount you have paid to Applied Science in the 12 months preceding the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence or for fraud.
You agree to indemnify, defend, and hold harmless Applied Science, its directors, employees, coaches, affiliates, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from: (a) your breach of these Terms; (b) your misuse of the Platform; (c) your violation of any law or third-party rights; or (d) any Content you submit to the Platform. Applied Science reserves the right to assume the exclusive defence of any claim for which we are entitled to indemnification, and you agree to cooperate with us in such defence.
You may terminate your account at any time by contacting Applied Science or using the account deletion feature within the Platform. Applied Science may suspend or terminate your account immediately, without notice, if you breach these Terms, if your account is inactive for more than 12 months, or if required by law. Upon termination, your right to use the Platform ceases immediately. Applied Science may retain your data for a reasonable period for legal, accounting, and dispute resolution purposes. Provisions of these Terms that by their nature should survive termination shall survive, including sections on Intellectual Property, Liability Limitation, Indemnification, and Governing Law.
The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or reliability. Applied Science does not warrant that the Platform will be uninterrupted, error-free, secure, or that defects will be corrected. You use the Platform at your own risk. Any material or advice downloaded or obtained through the Platform is done at your own discretion and risk, and you are solely responsible for any damage to your device or data loss.
These Terms shall be governed by and construed in accordance with the laws of Malta, without regard to its conflict of law provisions. Any dispute, controversy, or claim arising out of or in connection with these Terms or the Platform shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, it shall be submitted to the exclusive jurisdiction of the courts of Malta. Notwithstanding the foregoing, you retain the right to bring proceedings in the courts of the EU member state in which you reside, as provided under Article 19 of Regulation (EC) No 593/2008 (Rome I), where applicable. Nothing in these Terms affects your rights as a consumer under applicable mandatory consumer protection laws.
Applied Science may update or modify these Terms at any time. When material changes are made, we will notify Users by email and/or through a prominent notice on the Platform. The "Effective Date" at the top of these Terms indicates the date of the most recent version. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Platform and terminate your account. A version history of these Terms is available upon request.
The Platform integrates with third-party services including Stripe (payment processing), Google (authentication), and email providers. Your use of these services is subject to their respective terms and privacy policies. Applied Science is not responsible for the practices or content of third-party services. Stripe processes all payment transactions; by using the Platform you agree to Stripe's Terms of Service and Privacy Policy. Google authentication is governed by Google's Terms of Service and Privacy Policy.
These Terms, together with any policies or guidelines referenced herein, constitute the entire agreement between you and Applied Science with respect to the Platform and supersede all prior or contemporaneous understandings, communications, and agreements, whether written or oral. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.
